Medozone Technologies LLC, a Nevada limited liability company and its managers, officers, employees and representatives (“Medozone”) declare that:

1. The Omega V units can only be sold to Licensed Veterinarians. “Licensed Veterinarian” means a person who is validly and currently licensed to practice veterinary medicine as granted by law. A copy of license must be attached to purchase orders.

2. No claims, written, verbal, direct, indirect or implied are made for any cure of any disease, any medical conditions nor any medical benefits or any benefits in general to influence the Licensed Veterinarian in his/her choice of utilization of Medozone products.

3. A Licensed Veterinarian must exercise educated caution based on his/her own research regarding utilization of ozone in his/her area of practice/operation. It is the responsibility of the Licensed Veterinarian to familiarize himself/herself with the properties and action of ozone in his/her field of activity. Utilization of Medozone products is the sole responsibility of the Licensed Veterinarian and is based on his/her sole professional judgment. The outcome of his/her actions and treatments, remains his/her sole responsibility.

4. The Licensed Veterinarian shall determine the suitability of the product for his/her intended use and shall assume all risk and liability in connection therewith. This will include all items sold or distributed by Medozone.

5. No medical claims are made regarding the usage and benefits of the Medozone products utilizing ozone including but not limited to Omega V units. Any past, present or future medical claims are officially rejected. Medozone disassociates itself of such medical claims totally and unequivocally.

6. Medozone products are not FDA or any other test laboratories or agencies tested or approved.

7. Medozone does not claim any tests, research, lab protocols or studies in support of its products.

8. Medozone’s Omega V unit is not for internal use or application or any incorporation into bodily fluids. Any pressurization, injection, infiltration or cavity application or any other application than topical application in a non-pressurized condition is not advisable and may cause harm or death.

9. The Omega V units are not developed nor designated for human application or utilization in any form.

10. Medozone assumes no responsibility for any action, damage, accidents, injury or death of anyone based on the utilization of Medozone products.

11. Medozone accepts no responsibility for improper use of its product.

12. Medozone is not responsible in any way for any and all bodily injury and property damage that may occur from the use of, or caused by, Medozone products.

13. In no event shall Medozone or its affiliates be liable for indirect, incidental, special, exemplary, punitive, or consequential damages of any nature including, but not limited to, loss of profits, revenue, production, or use, business interruption, or procurement of substitute goods or services arising out of or in connection with the use or performance of Medozone product, whether based on contract or tort, including negligence, or any other legal theory, even if Medozone or its affiliates has been advised of the possibility of such damages.

14. Medozone or its affiliates’ total aggregate liability for damages of any nature, regardless of form of action, shall in no event exceed the amount paid for the product by you for the product upon which liability is based.

15. The recommendations and suggestions regarding product application and use that are offered in product brochures, or information provided by Medozone are a guide in the use of its products and are not a guarantee to performance. Medozone recommends that operators and users of Medozone products ensure that the intended use does not violate any Federal, State, or Local laws.

16. The Omega V or any other products of Medozone may not be used for unlawful purposes and that use is expressly prohibited under the terms and conditions of it’s use.

17. This Disclaimer and Position Statement is governed by the laws of the State of Nevada, USA. You hereby consent to the exclusive jurisdiction and venue of the Courts of competent jurisdiction in the State of Nevada, USA, in all disputes arising out of or relating to the use of this product. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

18. This Disclaimer and Position Statement represents the official statement and position of Medozone in accordance with the current laws and regulations pertaining to manufacturing of medical devices and expresses its official position of not making any medical claims, recommendations or suggestions to anyone in regards to its products or technologies.

Any purchase or sale of Medozone products must be accompanied by this Disclaimer and Position Statement signed by the purchaser. This product is offered to you conditioned upon your acceptance without modification of the terms, conditions, and notices contained in this Disclaimer and Position Statement.
